Few things here:

A) it's not illegal to play poker online. It is illegal for the credit card company's to allow their cards to be used to fund sites where you can 'gamble' for money. Many non poker players think poker is gambling, but those who play the game know how much skill is involved.



B) The definition of the word 'gambling' is really a big grey area because the the whole reason for trying to stop it is not because of the games themselves but because the government has at this point no way to tax you or otherwise profit from it themselves. Don't kid yourself, this is purely all about money.



C) You can join a site that says it's legal but still can't deposit using a CC on a US bank because the card company may block any transactions.
Gambling online in general is 100% legal from the USA as long as you are 18+
